Tylad Lungu v Lumankio Zulu and the Electoral Commission of Zambia

The petition concerns the Milanzi Constituency parliamentary election held on 13 August 2026, in which Lumankio Zulu was declared elected on 15 August 2026 with 5,004 votes. Tylad Lungu, the UPND candidate, received 4,424 votes. The petitioner challenges the validity of the election, alleging widespread illegal practices and misconduct by the 1st Respondent and/or with his knowledge. The allegations include violence and intimidation of voters, particularly in Kasambandota Ward, where the petitioner claims that the 1st Respondent and his supporters drove around a campaign rally while hooting, shouting and waving sticks, causing people to flee in fear. The petitioner also alleges that the 1st Respondent and his supporters later went to the petitioner's campaign manager's house while carrying sticks. The petitioner further alleges irregularities in the recording and announcement of election results. It is alleged that results at several polling stations were not witnessed by participating political party agents or monitors, that errors were identified in the results at Bombwe Polling Station but were not corrected, and that some of the results announced by Presiding Officers had not been ascertained by the participating parties. The petitioner therefore seeks, among other reliefs, an order declaring the election null and void, an order directing the Electoral Commission of Zambia to hold fresh elections within 90 days, and an order for verification and recount of the votes, together with costs and any other appropriate relief.
